Why
Mediation?
Mediation
provides a more Scriptural means of handling a conflict, than
does litigation, (1 Corinthians 6). It allows each party to
be heard by a neutral party, the mediator. It is much more relaxed
and less adversarial than litigation. Mediation also is far
less expensive than a litigated divorce settlement. Mediation
is much easier on child custody decisions and much less traumatic
to the children and the family.
Will
I be forced into a settlement?
Absolutely
not; mediation is to prevent a forced settlement, which would
occur in a litigated divorce. By agreeing to mediation you would
assure your right to be heard. Mediation does not remove your
right to pursue litigation. However, mediation is used instead
of litigation because of the stress and expense of a litigated
settlement. Each of the parties has a say in the conclusion,
whereas, in court the judge or the jury will make the decision
for you.
What
is the cost of Mediation?
The
cost depends on the complexity of the situation. However, it
is much less expensive than an adversarial divorce. If you are
considering mediation, contact me and I will discuss the cost
with you.
