Tax Brake with Robert G. Nath, Esq.

"The Cast of (Tax) Characters"

-
Week of 1/22/01 -
As you merrily prepare your 2000 tax return, it may be useful to have a list of the “characters” and IRS offices you are, or may have to, deal with. As the curtain rises, here they are:

Internal Revenue Service Center - This is the place where you send your return for filing. It's where IRS employees enter the information from your return onto your own, personal account with the IRS (called the Master File). This also where your return is “scored” for audit potential.

IRS Help Line - The IRS has many, many avenues of help. The first resort is to 1-800-829-1040, the 800-pound gorilla of phone trees. Work your way through that one and you may find your question answered. Be patient during tax season.

Taxpayer Advocate - This is the office that cures snafus. Formerly known as the Problem Resolution Office (and before that, the Ombudsman), this office has been staffed up to handle many more problems and issues. You can always turn to the Taxpayer Advocate for help; if that office lacks jurisdiction of your issue, they'll tell you where to turn. Bear in mind that red tape must usually be 45 days old to qualify for their assistance.

Revenue Officer - This officer collects taxes, investigates individuals for payroll tax defaults, secures unfiled returns, files liens, recommends collection suits for the Department of Justice to file, and does other jobs to increase the revenue.

Revenue Agent - This agent is the auditor of your tax return (except see below). His/her job is to review the correctness of your return and propose “adjustments”, which usually are in favor of more revenue (but not always).

Tax Auditor - Like the Revenue Agent, this is an auditor, but for lesser-profile or simpler issues.

Special Agent - If you meet one of these, you're already in trouble. These are the criminal investigators of the IRS, always well -trained and sharp. Their job is to investigate alleged violations of the criminal provisions of the Internal Revenue Code and related offenses.

There are many other players in the tax scenario, but these are the main ones. It helps to know their jobs so you can more effectively deal with the agency during this stressful tax season.
