- Pennsylvania Marriage FAQ's -


1) What is an enforceable premarital agreement in Pennsylvania?

Premarital agreements are recognized in Pennsylvania and are binding if there has been no fraud, misrepresentation or duress. There must be a full disclosure of assets if the agreement is be enforceable.

2) Is there Common Law Marriage in Pennsylvania?

YES. A number of states have statutorily prohibited Common Law Marriage, however, Pennsylvania still recognizes this type of marriage.

3) What terms need to be met for a Common Law Marriage in Pennsylvania?

1. there is an express agreement of the parties to assume the relationship of husband and wife; and

2. cohabitation and reputation are relevant factors in determining whether the parties have entered into a common law marriage. Living together and holding themselves out to friends, relatives and the government as a married couple is evidence that the couple is married.
