Changing The Terms Of The Divorce

Sitting in a New Jersey family law courtroom, one regularly hears judges and lawyers use the word "Lepis". They say things like "Lepis says"….&"Lepis mandates that…" and "Pursuant to Lepis…" etc. We sometimes hear people make comments like "what's a Lepis?" or"Who is Lepis?"

Lepis is not a person nor is it a thing. Rather, Lepis v. Lepis was a 1980 case decided by the New Jersey Supreme Court which stands for the proposition that child support, alimony, visitation/parenting time, and related issues are subject to review and possible modification, at the request of either party, whenever there has been a substantial change in circumstances.

This means that after the divorce, sometimes people can go back to Court to ask a judge to modify terms of the divorce judgment when there has been a significant change in circumstances.

The Lepis case is as significant today as it was when it was first decided over twenty years ago.

Largely as a result of Lepis, our law office represents many people who are already divorced but who have ongoing issues that need to be re-addressed by a Court.
