I have been married for 9 years and been living in RI for the past 7. I bought a house last year in march (My name is the only one on the deed and mortgage). We split up in march of this year. We have a son who is 9. Our break up is over extra-marital affairs. She does not work but does collect disability for depression currently. I work full time in MA.

Questions I have are:

1. She has family in California and has expressed some thoughts about moving there, is there anything I can do to prevent my son leaving without my agreement to this?

2. Is the normal child support ROUGHLY similar to MA in amount? ie about 1/3 of gross?

3. How difficult is it for someone to get long term alimony? She has made alot of progress medically and could possibly be able to get a job in the next year or 2, maybe even sooner if it became necessary.

4. What are my rights with regards to entrance to my home? I have no history of abuse and no restraining order against me. I want to maintain good faith negotiations with her, but at times things become adversarial. She has said she will not permit me to enter the house without her present. She also doesnt want me to be there taking care of our son. Where does the law fall on this subject when its purely a divorce case and has no issues of abuse?

5. Is there a manditory parenting class required to be taken? Can it be one thats also offered in MA?

6. If she did end up moving to CA, what would happen to the house? Would I gain it and have to pay her for her half of the equity? If she stayed and wanted to stay in the house, would it be possible that I would be ordered to maintain the residence for her? If so, would that be on top of child support as well?

the best thing you can do is to review the RI laws on dosmatic relaations which includes divorce, child custody, and supprt. Go the RI state home page at URL

www.ri.gov

On the page that appears, click on "govenment". On the next page that appears, you will see an option that states "statutes", etc. Use that to get vto the RI statyues and read the ones on divorce etc. Now a few particular things.

1. RI child support goes to age 18. MA on the other hand has college support which can go uo to age 23. The statutes will gove the child support guidelines from which you can figure csupport

2. To keep your son from going to CA, you will need to get custody to keep mom from taking him to CA. This a subject called child moveway. Look at the custody sections of the statutes.

3. As far as getting alimony, it depenbds onthe length of marriage and her ability to work. To max out on alimony, ex-wives usually allege depression, microphyagila(spelling may be wrong), and lupus. To avoid long term alimony, you will need to prove to the cort that she can work

4. To get you out of the house, the ex needs to get a "vacate the marital" home order from the court. It's hard to get one without proof of abuse and if she lies and gets caught, she'll be in big trouble. Have you gone to the R.I. fa3mily court on DoTrance st. to pick printed information
