timing of support payments

I am seperated from my spouse, and filed for divorce in january. We have not yet got a date for our hearing, but in the meantime, my savings are dwindling, as he is not paying any child support nor spousal support....When we finally get a court date, are the support payments retroactive to the divorce filing date? What can I do to speed things up. (I live in DE).

Geana Superstar Registered: 06/05/03 Posts: 6116	Unfortunately, we can't do a thing about speeding up the court processes. We just have to be patient and hope the most complete information from both parties is readily available at the first court appearance. Did you file for the divorce on your own or through a lawyer. You or your lawyer can try contacting the court clerk and check on the status of your filing. It's not uncommon to get a first court appearance 3-4 months from the date you filed. It seems slow though, that you were not yet notified of the court date. Retroactive is usually given from the date of filing, but sometimes you need to be sure to ask for it. If no mention is made of it during the court appearance, never assume it's automatic. Bring it up before you're out the door. _________________________ The best advice is to listen.
