Situation:

My spouse of going on 22 years marriage filed for a Legal Separation.

We had the house on the market before she filed and it finally sold, will be closing next week.

I understand that she is entitled to some of the equity. I need some advise from anyone that can help.

BIG QUESTION: Should I go ahead and split it or put it in escrow and let the judge decide. I feel that she is not entitled to any of it because of her previous actions

MORE INFO TO CONSIDER:

We have a son that just graduated this year and is in College. I am supporting him 100%, with car, auto insurance, home, everything.

She has abandoned the home more times then I can count since 1997.

The last time she left and never really returned was Feb 2003 just before our son’s birthday. I know, it stinks, but she has done worse. She stayed on and off at the house and the whole time maintained a mail box, storage , etc. She would go to her sis and b e gone for up to 2 to four days. She even started paying her rent. She never, never offered not once to help me with mortgage or expenses like elec, water, gas or phone. I finally got her to start pay Elec and Gas, that only lasted 2 months before she filed and left.

Now she feels she is entitled to whatever she can get under the law.

END: The story gets even deeper, but please consider my question.

I don't know the laws of your state, but from what a couple friends through, with their husbands leaving and coming back, and affairs, etc.. it didn't matter once it was brought in court.. they still remained married, and whats yours is theirs, and whats theirs is yours, unless a prenup was signed..

The judge didn't want to hear reasons, because they still had their names on the mortgage, and were married, they got what the laws said they were entitled too, with no excuses. The judge has to decide it.. she will fight it if you don't give her a cut.

Good luck though, maybe it's different in your state, I hope things work out for you.
