Aloha,

I will be in court tomorrow for a Post Decree Relief I filed to modify my visitation for reasonable to Type B. The reason for this is my x has moved to Virginia and refused for the last 3 years to allow my two girls to visit me here on the Island. I on the other hand have traveled to the mainland twice to see the girls..2001 and 2003. I don't feel I am asking much as too the PDRM. Type B visitation with the modification of we split the cost of the girls travel. He has refused on the notion that the girls are too small to travel alone...they are 7 and 13. Several airlines will let the older child serve as the chaperone as long as we pay for the escort services provided my the airlines. This is not a valid option for my x. He says that even thought we have joint custody, that the physical custody he has gives him the right to make the best dessions for the girls even if we both can't agree on visitation. So here I am ....He was so very angry that I drug him back into court that he has hired a lawyer. His affidavit in the case states that I am unfit and have never wanted to exercise my visitation before even when he was on the Island. He even goes futher to say if I do get to see them that I should pay for it 100% and that he will still thinks the 7 year old shouldn't travel with her sister until next summer at the age of 8. She will turn 8 on Dec. 29 of this year...I was so hoping they would get to come for Christmas this year to see the new baby brother. I am due in October. Sorry for the long type...at anyrate...I have probally posted to late, but I am wondering if there are any sites or insite that anyone might have concerning the procedures and what I should exspect to happen tomorrow. I will be defending myself against the lawyer and really don't know what to espect...
Please help if you can.

First I want to say good luck tomorrow. Since you know the issues he's going to try to use against you, be prepare to defend yourself as truthfully as possible. State what you said about the airline travel and assistants. Continue to stress that both of you should split the travel expenses or that even he alone should pay them, as he was he one who moved the girls away from you. He may have the final say in joint custody decisions, but not in hampering visitation. The only problem I can see with the airline travel itself, is the question of direct flights available from VA to Hawaii. A lot of these flights may require changeovers.
