Child Support Payments: CASE # 33C01-0007-DR-232 Henry County, Indiana
I desperately need help with child support issues! According to my and my employers records I have overpaid my child support obligation by $20k. My child support was paid faithfully through payroll deduction. The Henry County Prosecutor’s Office states that I owe approximately $10k in back child support. My children are now 25 & 23 years old.
The Henry County Child Support Division (ISETS) Records make no sense. When I first got divorced, there was no child support. My daughter lived with me, and my ex-wife had custody of my son. My daughter lived with me from 2001 to April 2002, then moved in with her mother. In 2003, my ex-wife took me to court for child support on both children. She sued for back child support for my daughter for 2002. I was paying $350 per week, $84 was to go towards arrearage for 2002 per the CS Order, the rest for current child support. But The Henry County Child Support Division records were not kept according to the court orders, resulting in me being behind in either the current, or the arrearage, when in actuality, I OVERPAID! They even kept my 2004 tax refund of $7,000 +/- for arrearage that was already paid off. But my employer continued to pay $350 per week. Then the CSD realized, I had overpaid the arrears, (that I never received credit for) and they reduced my child support to $266 per week. Then my daughter turned 21 and my son started college. According to the most recent Court Order, the Child support was stipulated to be $62 per week, (the final order states $67 per week) but my employer continued to take $266 per week from my check.
I also have a Court Ruling dated 12/22/05 that makes absolutely no sense. It states that I owe my ex-wife and her attorney approx. $20k. The entire Order is completely full of errors and untruths. For example, it states, among many other things, that I owe approx. $8k in medical bills for my children that either I, and or my insurance has already paid! The Judge, Richard T. Payne, Probate Commissioner took what her attorney had and signed it into order without even looking at any of my evidence.
Can anyone help me, and other non-custodial parents, fight the way that the courts handle Child Support Payments and subsequent Court Rulings are handled?

Were you in court when the ruling was made? Did you have an attorney?
