I’m hoping for some advice from a Californian. My daughter’s mom moved her to California without getting court permission, in fact, I didn’t find out about the move until after the move. Mom kept it secret. My family court jurisdiction is in Nebraska, but I am now living in Iowa. Iowa is a very progressive state compared to Nebraska and I am certain that I would have a stronger voice in Iowa. However, the Nebraska family court would never approve a transfer of jurisdiction to Iowa as that is not where mom lives. Mom makes $175K to my $70K, but travel expenses were ruled to be my sole burden from the start. I took that to the State Supreme court and I lost. Ironically, the only Supreme Court judge to be on my side was the sole woman on that panel of judges.
In Nebraska I never encountered a judge that wasn’t still living in the ‘70’s. I went through some very rough times and those judges’ rulings only accomplished one thing and that was to bend to the wishes of a narcissistic mom. She crucified me and the courts were her willing enablers and she created 9 years of legal entanglement that has cost me over $50,000.
My question to this forum is should I transfer jurisdiction to California? The laws in Nebraska are written such that, basically, a judge can override everything and anything pertaining to those laws. In NE fathers are guilty of being a bad parent until proven innocent. There is no such thing as accountability. A judge’s rulings go unquestioned and are nearly always upheld in higher courts. Under what is opposite to what should be my civil rights and when hearsay rules the day and when mom can lie and it is accepted without supporting evidence then guilt or innocence becomes irrelevant. A daughters need to have a close and meaningful relationship with her father becomes irrelevant. "Best Interest of the Child" is just a warm and fuzzy thing to put into "law".
In my 9 years of legal entanglement it seems to boil down to which judge you get. In my jurisdiction the judges have held their appointments for decades. As far as I can tell they have never been challenged to do anything other than what they have been doing for decades. I'm a good person, but I feel like convicts in our prisons have more civil rights than I do.
Through my experiences I am scared to death of filing one single document to gain more rights as I usually lose more than I gain. Can I get a fair shake in CA?
