I have recently completed mediation with my stbx. We are separated, and have bought our own houses. He's not ready to file for divorce yet, but I am. He doesn't think we should, until one of us is ready to remarry. I don't agree with that, and would prefer to not be linked to him financially anymore.

What is the real difference between legal separation vs. divorce? I mean, why do people go through the cost for the legal separation instead of filing for divorce?

One reason is to retain medical insurance benefits under a spouses policy.

New Jersey does not have legal separation. It's either divorce or stay married, which means that you could still be held liable for any and all debt incurred, even after you stopped living together.
