I was told today that there is a new law that enables a noncustodial parent to grant their spouse rights to their child's educational records and also give them rights to contact school teachers, etc. to discuss the child's education.

Anyone hear of this?

This isn't a new law. There are limitations. The school is only required to give 1 "set" of educational records, so they would have to pay for copies. The school is also not required to provide for separate conferences. Stepparents are allowed to discuss educational issues with teachers (grades, absenses, homework, etc.). They are not allowed to make any educational changes. Only the 2 biological parents are.

According to FERPA, a residential stepparent has the same rights to educational information as a parent. But a nonresidential stepparent does not have any rights to educational information.

When my stepdaughter (now 26) was in high school and was skipping alot, I would call daily to see if she was there. Most of the staff would give me the information, but there were a couple that told me they could only give out student information to the biological parents.
