So as I understand in VA if a spouse is sentenced to one year or longer in jail for a felony one can file for divorce. You don't have to wait for the sentence to be complete, gavel down, sentence handed down you can file for divorce?
I am wondering about alimony and the like, can the convicted spouse still seek that behind bars?

1) You need an attorney.
2) I believe you don't have to wait.
3) The marriage must be at least over 10 years for any alimony to be considered.

You can seek anything you want, but it's up to the court's decision.
