So my ex claims I owe him money and is withholding my child support payments. We are still going to court in regards to our community debts and assests. Can he do this?

Not legally...the child support is court ordered. A person cannon withhold CS for any reason...not for denial of visitation, not because the payee owes them money. You can sue him for contempt of the order.

Your ex is not a judge nor jury. He cannot go against court orders by simple choice. Otherwise, anyone could just up and claim anything.. couldn't they?

Now, if the state is enforcing child support, he will automatically go into arrears, and if your state charges interest - they'll begin building up interest on the late payment.

Property division is a separate issue from child support. He has to continue to support his children, and he and you will eventually work out any differences with regard to marital property in the court.

I assume you have a lawyer? Tell him/her immediately.
