Well interesting case as it unfolds..

APRIL 09:
I filed for divorce back in April of this year. In Texas, I was not required to notify my spouse of the filing. I was instructed by my lawyer to file before I moved out in order to protect my access to my 3 kids. Basically, if nothing is filed, the courts and/or law enforcement have nothing to enforce.

JUNE 09:
In mid-June I notified my wife that I filed for divorce, and I e-mailed her a copy of the divorce petition. It was a very simple 3-page document with names and birth dates, along with some other items describing venue.
My wife's lawyer responded to my original petition. This document was very long and detailed with things about custody, visitation, money, etc.
Also included was a line item about support payments, originally requested as $3,500 / month.

NAMES: I am (Original Petitioner and Counter Respondent)
My spouse is (Respondent and Counter Petitioner)

JULY 09:
I responded with a reduction in support payments, and edits to other items.
We have now had a list of about a dozen items that we have been negotiating back and forth.
We should be settling on the Temporary Orders soon.

After temporary orders, we should be moving forward to the final divorce settlement.

I just wanted to inform folks about how the process works here in Texas. Also, be sure to work out as much as possible with your soon to be ex. There is no reason to pay lawyers to fight if you can agree for free....
