I have been married 25 years and my husband voluntarily went into active duty army. He had a civilian job and going into active duty army reduced his pay by $28,000.00 a year. He knew we were going to be short of money each month. Well he has done this 7 years out of the last 9 years. I had to open credit cards (using his Power of attorney) just to pay the bills and buy food. But now the credit cards are up to $80,000.00.

Now, he wants a divorce and he is going to say that I opened the credit card in his name by fraud and will not pay for the cards. I am really scared that he will be able to do this. I have all the credit card statements and for the last 20 years I only used the card for unnecessary things in the amount of $3,000.00.

A bankruptcy attorney says that we qualify for a Chapter 7 and will still be able to keep our home but my husband will not do it. If I file for bankruptcy by myself then I will not be responsible for the credit cards but if the Divorce Judge says that I have to pay half of the cards then i will be responsible.

This is alot of information but I am scared of what will happen. He lives in Virginia and I live in Illinois and he will not send me any money home. My attorney is trying to get child support and maintenance and he tells me not to worry but I work in the legal field and I know that sometimes what happens in court is not fair.

Has anyone ever been in this type of situation before?
