My daughter is 13. I do not believe she is old enough to have a cell phone. Her father is aware of this. I am the CP, and we have joint custody.

He bought her a cell phone, and she came home from weekend visitation with it today. I told her that it had to go back to her father. Well, that was not popular with him. He is threatening court, saying I have no right to take it away.

He has unrestricted and private phone access through our landline. I told him that if he so chooses, our daughter can use the cell phone during his visitations.

Can a court compel me to allow my daughter to have a cell phone when I don't believe she should?

In this culture, I don't believe a court in the land would allow you to take the phone away. However, it doesn't mean you can't set rules in your home.

He has no case. She is your child and in your own home, you can set any rule you want as long as it doesn't harm the child. Since the child has unrestricted phone access through landline, there is no need for the cell phone to make contact with him. He and the child can feel free to use it when the child is with him.
