I am going through the divorce process but have to wait for the bankrupcy to be finished so it's taking a bit longer. We also have 2 children together 1 & 5. I am wanting to move in with my new GF to cut down on my expenses. The wife is saying that doing so I will forefit some of my rights. something along the lines of "divorce by default". basically the judge can grant her anything that she wants. How true is this?

Well, it's not true about "anything" part but certainly you won't look good in the front of the judge if she claims your infidelity during marriage. Even if you didn't commit during marriage, the fact of moving in with a new GF so soon could create doubt in judge's mind. More importantly, your so soon involvement with a GF will complicate your divorce since it will fuel your ex's jeolousy and resentments. My advice is to try to find a roomate or sharing a house, not with a GF.

Plus...you have two small children...can you imagine how upsetting and confusing it will be to have a new "mommy"...they are going thru enuf right now....bite the bullet and maintain seperate households for the kids sake and to ensure the rest of your divorce goes smoothly
