Hello,

My court is the 20th circuit court in Florida. Lee County Florida.
I filed a simplified petition. No children, no property. It has been 30 days and I am waiting for her "answer and waiver." She called me to ask if I want to go to counseling with her. I have agreed. Instead of withdrawing the petition, am I allowed to postpone the petition or put a hold on the petition? How should I ask the clerk that I do not want to withdraw, but just a postpone or hold. How long can I postpone? thanks.

What you want to request is an "abatement" of the action. You have to file a motion to ask for it. 90 days is typical for an abatement period in my area and you can ask again at the end of it if you need some more time.
