My husband and I are recently married and live in one state while he pays child support for his child who lives in Florida. My husband is currently in the military, but will be retiring in a few months. Can we file child support mod prior to his retirement date? And when the evaluation comes up, will my income be included as well? I was told that under Florida law it would be considered even though I have always lived and worked in another state. Is this true?

Only the income of bio parents is included in the calculation.

If you file a modification case now, just be sure your pleadings clearly give the effective date.

Also research whether a military retirement is a substantial unforeseen change. In general, retirement is not unforeseeable and won't be the basis for a mod action.
