I have been married for nine years and we have three small children. When we married we were young and neither me nor my husband had much of anything. We started a service business together. Over the last nine years my husband has went to jail many many times for DUI, drugs, etc. On several occasions he was in jail for 5-6 months at a time. During that time I ran the business, payed all the bills and took care of our three children.
Urgent problem:
He has very recently returned home from being in jail again for 5 months. Within days of returning home he abused me very badly infront of our kids and for the first time ever I filed charges and had him arrested. He was bonded out by his mother and has now fled because he has a warrent for his arrest due to probation violation. When this happened he completely drained our checking and savigs accounts (a pretty large amount} and left me and the kids with nothing but a credit card to survive on. I can't even run the business with no money. He left a message stateing that I can just work and make more money.
Question: If he is caught and arrested how can I go about getting some of the money he took back? I am alost 100% sure that he has or will give it to his mother for safe keeping. I know he will lie about what he has done and where it all went. What can I do now or then (when he is arrested to get the money back? If he did give the money to his mother can I even do anything about it or prove it?

That's awful. I'm so sorry to hear what happened. So long as the account was in both your names I can't think of anyway for you to get the money returned, especially if he's blown it going undercover and using drugs. I doubt very much if there's reason to obtain his mother's accounts to check on deposits and withdrawals.
