Martin, Attorney At Law, Roy Martin is a graduate of Johns Hopkins University (Bachelor’s Degree, 1985: Biology, Chemistry, Physics and Math), and of the University of Arizona, (Juris Doctorate, 1996 Magna Cum Laude). Having excelled in law school, graduating 13th in a class of 164, and having served on law review, he chose to practice domestic relations law based on his own personal experience. In his first year of law school, he went through a very difficult divorce. He went back to court to re-litigate custody in his second year of law school. On Jan 14 2009 the court ordered a Stopping of Order of Assignment to my case. On the same date the court ordered a Re Modification of Child support naming my ex wife as the new Obligor. This was put into effect after custody of our son was modified in 8/08.

I still have not received any payment from the clearinghouse. I can not get through to the Divison of Child Support Enforcement. I have both faxed and mailed them copies of both orders. I have also mailed copies to my ex's employeement office. I've been online with the Division of Child Support and my case has not been updated. Does anyone know what my next step is?

It is so incrediably hard to get through the Child Support Enforcement. In your case online, there is a way to "Contact Us". Click on that and then choose "Ask a question". Type in your question and they usually get back to you in 2 days.

Yes, it's hard to get through to them. My list of back numbers to the individual Assistant Attorneys General is one of my prized possessions. However, the attorneys will take calls only from other attorneys. Otherwise, you have to speak with the Caseworker.

Typically, it takes the Clearinghouse a good 30 days to process that first payment. It also generally takes at least couple of weeks for the Order of Assignment to get to the employer and for them to being deducting funds from the paycheck. Technically, your wife should be making any payments not being withheld from her paycheck directly to the Clearinghouse. Needless to say, most people don't. Instead, they wind up with a small arrearage which accrues interest.

Hard to say whether everything's going according to script. You'll know when (and if) you receive that first payment -- direct deposited into your bank account -- that the gears moved at their typical slow pace. If nothing happens, you'll have to get through to someone at Child Support Enforcement or retain counsel to do so on your behalf. Best of luck.
