The legal beagle at the law library said that the definition of children in a divorce situation means any children whether or not they were born during the divorce, adopted, or (in my case) from prior relationships.

Do I have to file with children or can I do a simple no-child paperwork because the situation with the kids is already legally solved. She has her daughter and I have my two.

Thanks,

Jim

If the children are all from previous marriages and their custody is not at issue, I think you can essentially ignore them. If your stbx agrees to the divorce and the basic terms, I would advise having an attorney do the paperwork. The attorney can advise you of such issues.

As long as all the children are being supported by their own parents, there's no need to involve the children in the divorce settlement.
