My ex owes me about 3,000 in extra ordinary expenses. our orders were modified in Sept 09 but still include his obligations in this area. he has indicated to me that he wants to re-do the orders again to reflect real income and to get out of paying for these obligations. It seems as if I file for Contempt, it may open this door for him. Does anyone know of other options I have to collect - can I take him to small claims or do I have to stay in family court? Is there anyway to get a judgment other than a Contempt of Court? Thanks.

Family court, contempt.

WA is Cp mother biased, I wouldn' worry too much. If he files for mod reducing CS, and actually gets it, it's likely fair.

Yes, he agreed to the arbitration award and wont follow it - when I have submitted the invoices and receipts for the expenses he writes an email on the 30th day stating that he disagrees. Not sure why as it is all in black and white in the orders. The state won't collect them and it is not really clear what my options are. Can I take him to small claims instead of contempt. Everything I have read on contempt seems like a lot of judges frown upon it and are hesitant in holding someone in contempt. Anyone have experience in this?

I disagree with you. I am a mom who has been raising my children with very little help for the past 9 years. My ex made between 150,000+ and up and quit his job 2 days after I filed for modification. My orders had not been modified for nine years. He was capable of working - just chose not to. He lied to the arbitrator and said he was unable to find work. Come to find out after it was all over - he already had a job. During this time he traveled extensively to some exotic place and lived a pretty plush life. Not only did he get his cs reduced significantly, but I now am responsible for a lot more than I was - even though the orders hadn't been changed for nine years.

Let me try my question again? Do you really mean that the orders were modified seven months from now? Or do you mean September 08? Or September 07?

LOL there is no 'agreeing' or 'disagreeing'. Wa is a liberal, mother-biased state. A mother must be shown to be a drugged out homeless lady in order for a father to get so much as 50/50. This isn't opinion, it's fact.

Your ex not paying has nothing to do with the state being or not being mother biased. How is a court suppose to control his quitting his job two days after a mod? LOL...

You better get one thing straight right now if you wish to survive: this is not a communist country (close...but no cigar). It is NOT the gov't responsiblity to see to it that you and your ex are both contributing totally even toward the upbringing of your child. If you chose to create a child with a loser, that is your issue. Deal with it. I would suggest budgeting without considering his CS or extra money.

BTW:
Exraordinary expenses are usually included in CS. What are you referring to, exactly? Split costs of sports, etc? If so, does the father have legal say so in the decision making?
