Martin, Attorney At Law, Roy Martin is a graduate of Johns Hopkins University (Bachelor’s Degree, 1985: Biology, Chemistry, Physics and Math), and of the University of Arizona, (Juris Doctorate, 1996 Magna Cum Laude). Having excelled in law school, graduating 13th in a class of 164, and having served on law review, he chose to practice domestic relations law based on his own personal experience. In his first year of law school, he went through a very difficult divorce. He went back to court to re-litigate custody in his second year of law school. Hi everyone.
Can anyone shed some light on this situation?

I am required to provide medical insurance coverage for my children in my divorce decree,which I do.

In the past few years, my ex had subsequent children and since there was no additional cost, he added our children to his medical policy.

My question is: Is he required to disclose their medical insurance coverage information to me, as I am required to disclose my coverage to him?

Then that's all it requires. If it didn't state his disclosure, he is not obligated to tell you about his own insurance. His insurance may be a secondary insurance to cover whatever yours doesn't and it will save you money from out of pocket cost which required both to share.

When there's a duty of child support, parents are obligated to disclose income and insurance coverages every 24 months. In addition, if either parent believes there has been a substantial and continuing change in circumstance, he or she can request disclosure and/or file to modify the support order.

If it makes more sense, economically, for your ex to cover the children, the court will modify the child support order. The court will favor that result which is most efficient for the parents, in light of both the quality of coverage and its cost. So, in answer to your question, you can request disclosure and, if it's not forthcoming, you can file a petition to modify child support and demand disclosure as part of the modification process.
