If you read my post, you will see that the original order, or modification, must contain a provision for post-18 support. If it does not, your DH is off the hook.

Moving the case to OR doesn't make sense to me (but neither does quitting a job and following a bf to OR). Even if she does get OR to take her case, the modified order would have to include that provision. So I wouldn't worry too much.

If she does file for modification in OR, be sure to have your DH request income from her previous job to show she is deliberately underemployed.

Meanwhile, if you're paying child support through a CA CSU distribution center, continue to send them there after she moves. It is up to his mother to notify the court of her forwarding address to or she will need to keep her current bank account and atm cards. Continue to keep records of payment and ensure that upon any transfer of the case (should it happen) that DH requests the closure papers and a detailed accounting of his payment history. There's plenty of situations here where some BM's turn around and try to double-dip during these case transfers.

I would think BM needs to be super speedy at changing to all the appropriate information. She's probably going to need to show proof of residency. Though not necessarily any amount of time, she'll probably need utility bills, OR driver license, etc. Not to mention, it can take months for cases to completely transfer between states. Who knows, by the time the six months passes between their actual move and son's 18th birthday, she'll miss the train.

Thanks everyone for your responses.

I received a response from Attorney Gorin on another board, saying that if the original CA order terminates support at 18 then OR can't change it to include CAS.

Thank goodness! It makes it a much more level playing field trying to work with him on college.

We have always made payments directly to CP, so we'll just keep mailing it to her at her new address.

So, if she does move the case to OR at least support increase will be temporary, if she asks for one.

Again, thank everyone here... I may be back with more questions. Who knows....

L D Gorin is the best! He used to post here more a few years ago. He really knows his stuff.
