My husband and I signed final divorce and parenting plan about 1 month ago. I am supposed to go to court next week to finalize. Since we signed my husband has swore he has changed and had for a moment convinced me. During that moment we were intimate. Almost immediatly after, he told me that the agreement was null and void. Is this true, what should I do? Please someone help!

Since the judge hasn't signed yet, I'm afraid you have to start everything over. Why bother with the divorce while you are still interesting in having intimate with him? You should set your priority straight.
No question, he tricked you into getting out of the agreement for whatever reason. You must find out from him. Otherwise, if he still agrees and still wants to proceed, nobody knows but you two if you know what I meant.

Brandi, do not take the above post to heart. The poster is not an attorney and has no final authority to make statements as: I'm afraid you have to start everything over.

If you have an attorney, speak to yours about any consequences. Unless your husband has videotaped this or you became pregnant, he has no proof. I, personally, would not admit to this. Hearsay.

I echo HevnMaidMe - there are several posters that like to see themselves post, and literally post out out of their....well anyway.

I did a little research http://research.lawyers.com/Tennessee/Divorce-in-Tennessee.html
http://www.justiceondivorce.com/divorce/index.html
http://www.memphisdivorce.com/trial.html (this has a lot of good information)

It's not addressed specifically, but there are no warnings about it, like there are other issues. I agree to check with your attorney.
As far as I've heard it's either Washington DC, or Virginia or somewhere back there that actually looks at physical relations between a couple that counts towards the timing of a divorce, certainly not the agreement about a divorce.

I'd be careful if it came up in court with the difference of not admitting something, and lying under oath :)

If there's anything that should indicate a non-change in a person, it would be trickery like this. Steer clear as much as you can.

It would set the clock back in VA. TN may however be different. I agree with Hevn. Speak with your attorney about the consequences. However, do know that your attorney will probably not allow you to lie in an affidavit or deposition if the specific question is posed.

The consequence of this will vary greatly from state to state. In TX, it would have no effect. The husband and wife could have sex 3 times a day every day and the divorce would proceed unhindered. I know it's different in some other states. I don't know about TN.
