I live in Iowa wife and daughter are in MI she has legal custody and we have joint physical custody. I pay child support although we are not diviorced because I live out of state and she got help from the state of MI. Everything is worked out as far as properties soforth. We agree on everything how do i get the ball rolling from Iowa.

If you have met the residency requirement, you simply talk to an attorney who can prepare the necessary documents. Having said that, if you think your wife will be cooperative with things, it's MUCH cheaper to agree on a settlement and just have the attorney write it up.

Ask your county clerk where online you can retrieve divorce documentation. Print it out, depending on how you want to structure the reason for divorce (irreconsillable differences, hopefully if you expect an uncontested divorce- nothing to fight for that is), fill out form, sign it in front of notary, submit docs to county clerk. They will file it and give you two copies - one for you and the other you must serve her constructively (sheriff I suggest). She then has to answer or counter claim or she might wait to come to the hearing if she contests to your petition for divorce. When you get to the hearing if she is not there the judge will ask you some questions trying to feel out the situation. The less you tell the judge the better. Keep it simple. We don't want to work it out.... This will cost you about $90.00 if you file it in court. Having to serve her will cost you maybe $50.00. Check with her county sheriff for procedure and cost.

Completecase.com will costs $250 to write it up for you and you still have to pay the court the filing fee, and pay the sheriff to serve her.

You want to make sure everything is done correctly. Engaging an attorney simply to write the documents will only cost a couple hundred dollars or so. It's not the same as hiring an attorney to fight with the other party.
