Ok...

I am now a pro se litigant suing my ex for over 11 thousand dollars in child care expenses he did not pay a dime of...2 1/2 years. This is a PART 2 of a modified order entered last Sept. This is what is left.

My ex is (not just venting this is the truth) a sociopath, thief, liar, con, stolen from everyone and everything that comes into his path.

My question is, I have sued for these expenses, to be split pro rata..this is a small town court and I know that getting any more than that ain't gonna happen!

I have drawn up an income withholding order-- How does this work...do I send this in to the court, do I file for discovery to get the address and other pertinent information of his employer?? If I call his attorney he will stall, and my ex won't respond to anything...

He took a lesser paying position just prior to our final custody hearing so his child support would go down,,,well now he has gone back to the higher position, BUT since the CHILD SUPPORT portion of the modification has been ordered...and this part (reimbursement) hasn't...am I still bound by the 12 month rule to get these pay stubs and get the actual amount he really is getting paid??

Also, I have sued for attorneys fees...am I to have a specific number in mind....gee....how much out of 14 thousand dollars shall I go for?? AND I have filed him in contempt which is a given...not question of guilt or not there...but what are the "fees" associated with contempt??

I am confident about my case. I just need to know some inner details

my understanding is that you can sue for all attorneys fees associated with the other party's failure to comply with existing orders....NOT for attorneys fees associated with creating NEW orders (such as modifications)...so sue for fees associated with contempt not additional orders

Are you asking if YOU should receive "fees" for your expenses as pro se?

sorry...don't have a clue about income withholding orders...

Oh boy do I ever know about the 12 month modification. If your exes support goes up or down more then 20% you do not have to wait for a year to get the support order modified. I am granny raising grandkids with an ex son in law that does everything to avoid paying anything for his children, we recently had to go back into court because he wanted paid for the summer vacation time he had with the kids an abatement. Lol his parenting time was figured into his support. So this time it went our way, he had to pay 500.00 in back support or lose his license. He did get 90 nights where he had 89 and his income went up by 20 percent, did not sign the order because he thought they were taking too much out of his check and it went to our judge to sign and we had the lawyer put a wage witholding on him and while the changes are made it takes about a month and when it goes through he will be another month and maybe more then 500 in arrears again and the judge is making the order because our two lawyers bickered over the amount. That should go our way because the last time we were in court judge told him you only pay 66 dollars a week and you can still not pay your support, his excuse well they forgot to take it out of my check. Excuse my sarcasim but DUH you see it did not come out of your check why not take it to the clerks office ya ole skinflint
