We were awarded Full Custody of my stepdaughter and Child Support as well. However, we have had to pay to get the Child Support case going and still nothing has happened. We contacted CS numerous times and to no avail we get the same response, it will take 6 months to get a case established. However, when the mother applied for CS she got it immediately when she had the custody. But since we have a court order awarding us back arrearage of CS and back pay of what we paid her since July but have yet to see anything. We have had my sd living with us since July and filed the papers in Septemeber since her mother said she would file the papers but she never did and I got tired of seeing the money taken out of DH check every week for a child we had, this went on till January with us paying and the mother still has yet to pay a dime and she has only seen her daughter 4 times since this has happened. Now that she knows we are fighting for CS she is trying to Bribe her daughter into coming back to live with her of which SD wont do. Any Advice on what else we should do to get the CS moving or do we have to sit back and wait

Have you went thru Child Support Enforcement ( which costs nothing for CPs, or no more than $25.00 ) or DHR?

They have a copy of the court order and we have dropped off the copy of the order. I have emailed them numerous times and this is the response. Thank you for your correspondence regarding your child support case. In regards to your inquiry regarding establishing a child support case, it may take up to six months (interstate can take longer) to establish a support obligation depending on the complexity of the case and whether paternity must also be established. The Child Support Enforcement Administration is committed to the enforcement and collection of Child Support orders and believes that both parents are responsible for providing security and support for their children. If you should need further assistance, please call 1-800-332-6347 Child Support Customer Service Maryland Department of Human Resources 1-800-332-6347 The problem is when his ex wife filed for the CS she got it right away, we have not gotten a court date only a paper from CS stating they received our paper work and it will take 6-9 months and to call the number listed. We only had to pay $25. We dropped it off right at the Child Support office in Carroll County MD and they cashed the check the next day. The problem is the mother is refusing to do anything to help her daughter andI have tons of hospitals/dr's bills that we are trying to pay on top of our other 2 children. I guess we just have to sit back and wait ... Thanks ..

I am confused at to what the court date is for? It sounds as if cs was ordered and being routed through CSE, where the paperwork is tied up. Something doesn't sound right here. Be the squeaky wheel to CSE and ask them what the status is? Six months is a long time to get a case established through CSE.

The court date was for Modification of CS and Custody. The mom threw her daughter out in July b/c she could not handle a teenager so we took it as she did not want her in her house so we fought for the custody and we were awarded CS and the Custody. However, when I called the courts after we receievd our papers, I was told it was sent to the States Attny office and to Carroll County CSE, but we had to get the ball rolling to have his check stopped being garnished so we had to send the copy of the order to Baltimore CIty. I thought once we had court papers all they had to do was Transfer the case ( that we were paying her) to our County and we would start to get CS, WRONG.. We have not gotten a dime except for the payments he made 10 of them from December till the middle of February back to us once they got our paperwork. So we had to file our case in Carroll County by ourselves even though the papers state we get Retroactive CS from Septemeber, plus the CS paid from September - the court date - the money we received from them holding the payments, but we don't have a set amount since the mother has not yet sent in a financial statement and she says she wont send one in. We have given them her employment and they have yet to do anything. I dont know what else to do or who else to call since we have called CS and they tell us the same thing over and over it can take 6-9 months. Could the hold up be since the mom did not do the financial report.

Sorry to ask more questions...but just need a little more clarification. In court your DH was awarded child support and custody. Was an amount established for the mother to pay? Was their a method established or ordered for her to pay...such as private check, wage garnishment or paying directly to CSE? From what I am reading you and DH were able to stop his payments, but has yet to recieve CS. Depending on if and how a CS was established depends on your next step to get the ball rolling. I am not quite sure what her filling out a financial statement at this time has to do with anything if a CS has been established. If CS is already determined and on the court order and she is not paying as ordered, you file contempt. If the problem is that CS is ordered and supposed to go through CSE...then you need to file the form with CSE to give them the info. If no support has been ordered, your DH needs to file a modification of CS. I doubt CSE will automatically take the court order and stop your husband's payments/garnishment and change it to the ex's payments/garnishments without the proper forms. Employer info etc. has to be provided. Let me know the clarification as to where you guys are in all of this. But I still am not seeing where the financial info from her has any bearing on anything except if CS has not been established as of yet. It just seems that there is something that you can do here instead of waiting. It looks like some link is missing in this and needs to be completed.

No there was not a amount set since the mother did not turn in the financial statement. She bluntly told us she threw it away, we asked her to go and get the CS stopped back in July and she never did so we have been paying from July 07 up till January 08, with nothing from her and her still receiveing the support. However, the judge retroactived the support back to September and so we should have stopped paying since September, i will post what the outcome was from the Judiciary Courts. I will also add some of the emails from the courts. She has also since this all has happened stated she wanted to sign away her parental rights from her 14 yr old daughter so she does not have to pay Child Support, but told us we had to file the papers. If she does not see her daughter is she still liable for CS. I thought she would be but I don't know. We wanted her daughter and her to have a relationship, but neither want it, but DH says that he does not want her to sign the papers, b/c she is her mother (even though I am here to be her mom as well, she should still be in contact with her biological mom. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ From Judiciary Page.. We were the DEF.. since we had to go off of Previous Documents Case called. Plt not present. Dft present without counsel. Minor ***** present in court. Testimony taken. Dft request custody of minor *** (DOB ******). Minor child testifed. Dft requests relinquishing child support to mother. Court grants request. Plt now liable for child support to Dft. BOCS to be notified. Court to issue written report. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ We filed Child Support Papers since nothing was done as of March b/c they told us we had to pay for that as well We have been writing back and forth with cs...
