Here's the scenario: Ex-wife and daughter live in Las Vegas and then moves daughter to Michigan to live with grandmother so daughter can attend school (daughter was expelled due to some trouble). Ex-wife never said one word about this to ex-husband. Divorce decree from Nevada states that the mother cannot move duaghter out of state without permission or court order. Ex-husband stops sending child support to ex-wife. What [i]should[/i] be done in this case? Thanks.

Child support cannot be stopped without the court order being changed, thus arrears + interest are accrueing. What does the dad want? He needs to go to court if he desires any kind of custody change and/or address the move.

We just went through this exact thing! Dh was paying for son who moved out of state. Dh stopped paying, and the mom moved him back and dh had to pay arrears. And now we are in court. it's a pita. How long has the kid been with Grandma? Keep track of that because if it's been at LEAST 6 months, then they are now a resident of MI. I would continue paying for c/s, (remember child support and visitation are 2 different things) and document EVERYTHING! Go see a lawyer and taker ex wife to court for contempt. Be prepared to get your c/s up to date, so YOU aren't in contempt of the divorce decree, and also get all your ducks in a row, like proof that the child is enrolled in school out of state. You have a good case (if you play your cards right) and you can get custody of your child, and have the ex wife PAY YOU child support! haha!
