I am seriously considering divorce now. My husband has had 3 DWIs in 4 years. Each time, he's promised he would stop drinking, and of course, hasn't. This last time, I told him if he starts drinking again, we're through. He's really sneaky about hiding the alcohol. He sometimes drinks when I'm out of town on business- I can always tell by his speech when I talk to him on the phone, but he denies it. Twice now I've found vodka bottles hidden in the trash- this time, it was an empty liter bottle-- and it wasn't there yesterday-- so he must have picked it up on his way back from a haircut this afternoon, while I was out.

I've also found 'suspicious' liquid in various containers in the house.

His behavior when drinking scares me- he gets 'itching for a fight' and will provoke one. He has pushed me during arguments and thrown things- we have holes in walls and doors to show for it.

The only thing that makes me hesitate is his general health- he is 64, and has emphysema. He has not worked in years- I've been the sole wage earner since 1991, and now would be unable to do much work. Help!

What should I be aware of, and do, prior to filing for divorce, if that's what I decide? We have a condo, which is in my name, and one vehicle- also in my name. (the second car was subject to forfeiture by the state after the third DUI--even though it, too, was only in my name.) We have about 4,000 in a joint money market account.

Your assets would be split, regardless of whose name is on them, including your condo and vehicles. You would possibly have to pay alimony because being the primary (or only) wage earner for 15 years. If you are near retirement, that amount could be possibly be adjusted down at that time. If you have a retirement or 401K, they also get split. In a nutshell, all assets accumulated during the marriage are split.
