I got divorced in 1992 and I thought that all was well. I gave my ex-wife everything and I took all the bills and paid them off about two years after the divorce. I paid my child support every month on time and also assisted with college and my daughter is now 26 with a Master degree and working. I retired from the military in 2000. Last month I received a letter from a lawyer requesting that I pay her 24,000 in back pay from my retirement income and then send him copies of my DD-214 and earning statements from every year up to present. I went back and looked at my divorce decree and it did not mention nothing about my retirement income but it did state that division property would be divided equally. 13 years ago the lawyer who handled my divorce told my everything was good to go and I did not know the law. My ex-wife did not show up in court for the divorce and I thought that it waived any rights she had to anything in the future. Her lawyer says that since she did not show up, its a default and she is still entitled to my retirement since Louisiana law states it. I was married for 11 years and have been divorce for 13 years. Are any time contraints on whats her time limit that she can come back and try to do this ? I am 40 percent disable and I am told that she is not entitled to that pay. Should I seek my own representation and fight this in court ? I just would like to know more about what my options are.

retirement income that you are currently receiving based on contributions made during the marriage would be considered a marital asset that should have been equitably distributed at the time of divorce. since this was not done, what your ex wife is basically asking is to revisit the property/asset distribution done in 1992. in most states, courts are very reluctant to revisit this distribution several years later, so she may very well be out of luck. but i would definitely recommend that you get a lawyer familiar with Louisiana family law. i wouldn't pay her a dime until you do.
